Identifying the cause of a fall at work

Wet floors, leaking equipment, trailing cables, uneven surfaces, poorly stored materials or unsuitable access routes can be relevant. Establishing that a person fell at work is not enough on its own. The claim needs evidence of the hazard, the responsibility for managing it and its connection with the injury.

Cleaning and inspection arrangements

Questions may include how the area was inspected, how a spill was identified and what was done before people used the route. A warning sign is one piece of evidence. Its location, visibility and suitability for the risk should be considered alongside cleaning, access restrictions and other precautions.

Employees, contractors and shared premises

The employer may not be the only organisation involved. A premises occupier, maintenance provider or cleaning contractor may have relevant responsibilities. The correct parties should be identified from the facts and working arrangements, rather than simply naming every organisation associated with the building.

Preserve evidence before the area changes

  • The exact location, time, lighting and floor condition.
  • A clear description of the substance, obstruction or defect you believe caused the fall.
  • Photographs taken safely, including the surrounding route and any warning signs.
  • Witness contacts, the incident report and details of available CCTV.
  • Details of footwear, cleaning activity, earlier complaints and relevant instructions.
  • Medical records, treatment receipts and evidence of time off work.

Ask promptly about retaining footage and relevant inspection or cleaning records. Do not alter the scene or expose yourself to danger to collect evidence. If you did not see what caused the fall, say so; the investigation should not begin with an invented explanation.

Does a wet-floor sign mean there is no claim?

Not automatically. The full safety arrangements, the placement and visibility of the sign and the circumstances of the fall need to be reviewed.

Can I claim if I work at a client’s premises?

Potentially. Your employer’s role and the responsibilities of the person controlling the premises must be considered. Agency and contractor arrangements may require additional investigation.

What if the spill was cleaned before a photograph was taken?

Other evidence may still be available, including witnesses, CCTV, incident reports and cleaning records. Record your recollection promptly and accurately.
