What does the Personal Injury Calculator show?

The calculator shows guideline brackets for general damages for pain and suffering. The figures are ranges rather than automatic awards. Where a bracket applies, the appropriate point within that range depends on the evidence and the circumstances of the individual injury.

What does the calculator not include?

The calculator does not calculate financial losses or expenses arising from an accident. Items such as loss of earnings, medical expenses, care costs, travel expenses and other properly vouched financial losses are generally considered separately as special damages.

How are multiple injuries assessed?

Where a person has sustained more than one injury, the individual guideline brackets should not simply be added together. The Guidelines generally require the court or assessor to identify and value the dominant injury and then consider an appropriate uplift to reflect the additional pain, discomfort and limitations caused by the lesser injuries. The result must remain proportionate to the overall effect of the injuries.

Why can two apparently similar injuries have different values?

The medical description of an injury is only part of the assessment. Relevant factors may include the severity of the initial injury, treatment required, recovery period, continuing symptoms, restrictions on work or everyday activities, prognosis and any permanent disability.

Medical evidence matters

The calculator cannot determine which bracket applies without medical evidence. A medical report may address the diagnosis, treatment, duration of symptoms, prognosis and whether any continuing problems are attributable to the accident.
